A Muslim Shall Not Be Killed for Killing an Infidel

The Prophet of Islam says: “A Muslim shall not be killed for the sake of an infidel”!

They said : The Prophet of Islam calls for racism… His followers have a special place with him over the rest of the people, even in the souls of the servants; so if a Muslim kills an infidel, there is nothing wrong with him…!

It was mentioned in Sahih Al-Bukhari, Book of (Blood Money), Chapter (A Muslim is not to be killed for a disbeliever), No. 6404: Ahmad bin Yunus told us, Zuhair told us, Mutarrif told us that Aamer told them on the authority of Abu Juhayfah, who said: I said to Ali: H Sadaqah bin Al-Fadl told us, Ibn Uyaynah told us, Mutarrif told us, I heard Al-Sha’bi narrating, he said: I heard Abu Juhayfah say: I asked Ali ( may Allah be pleased with him): Do you have anything that is not in the Qur’an? Ibn ‘Uyaynah once said: What the people do not have. He said: By He who split the seed and created the soul, we have nothing except what is in the Qur’an, except an understanding that is given to a man in his book and what is in the document.

I said: What is in the document?

He said: ” The mind, freeing the captive, and that a Muslim should not be killed for a disbeliever . ”

Response to the doubt

First: The objection to the hadith from the objectors is from his saying, peace be upon him: ” And that a Muslim should not be killed for the sake of a disbeliever . ” This is understood correctly from two aspects: The first aspect : The disbeliever intended in the hadith is only the disbeliever who fights; such as: the disbeliever who is a spy or a war criminal in the land of Islam… The disbeliever is the one who places a veil between himself and the religion of Islam; and the meaning of disbeliever is not that his blood is permissible as imagined by the malicious… And the disbeliever with respect to the Muslim is classified into five categories:

Kafir Muharib : A kafir who fights against religion, humiliates it, and oppresses the weak… This is killed on the battlefield or killed by the ruler or judge as a form of highway robbery; God Almighty said: The only reward of those who wage war against God and His Messenger and strive after corruption in the land is that they will be killed or crucified or have their hands and feet cut off on opposite sides or be exiled from the land. That is for them a disgrace in this world, and in the Hereafter they will have a great punishment (33) Except for those who repent before If you are able to defeat them, then know that God is Forgiving and Merciful (34) (Al-Ma’idah).

If a Muslim kills him before he escapes from his crimes and punishment…then the Muslim is not killed for him

infidel with a covenant : an infidel who has a covenant of safety from the ruler or the sultan. This is similar to: a tourist who enters the land of Islam carrying a “passport” with him…so he is not harmed based on his covenant with the ruler or the official…

Sahih Al-Bukhari, No. 2930, on the authority of Abdullah bin Amr, may God be pleased with them,

on the authority of the Prophet, may God bless him and grant him peace, who said: “Whoever kills a person under a covenant will not smell the fragrance of Paradise, even though its fragrance can be detected from a distance of forty years .”

3A disbeliever who has been granted security and safety: A disbeliever who seeks security and safety from any Muslim, so he grants him security and does not harm him… This is from the words of God Almighty : ” And if any of the polytheists seeks your protection, grant him protection so that he may hear the word of God, then escort him to a place of safety. That is because they are a people who do not know. ” (6) (At-Tawbah).

Sahih Al-Bukhari, No. 344, on the authority of Abu Al-Nadr, the freed slave of Omar bin Ubayd Allah, that Abu Murrah, the freed slave of Umm Hani bint Abi Talib, informed him that he heard Umm Hani bint Abi Talib say:

I went to the Messenger of Allah, may Allah bless him and grant him peace, in the year of the conquest and found him bathing and his daughter Fatimah was covering him. She said: So I greeted him and he said: Who is this? I said: I am Umm Hani’, daughter of Abu Talib. He said, “Welcome to Umm Hani’.” When he finished his ablution, he stood up and prayed eight rak’ahs, wrapped in one garment. When he finished, I said, “O Messenger of Allah, my mother’s son claims that he killed a man whom I have granted asylum to, so-and-so ibn Hubayrah.” The Messenger of Allah, may Allah bless him and grant him peace, said, “We have granted asylum to whom you have granted asylum, O Umm Hani’.” Umm Hani’ said, Happy and that is the morning .

non-Muslim dhimmi : A non-Muslim from the People of the Covenant who have been protected by Allah and His Messenger. He has what is upon the Muslims and is responsible for what is upon them…

Sunan Abi Dawood No. 2654 Sulayman ibn Dawud al-Mahri narrated to us, Ibn Wahb informed us, Abu Sakhr al-Madani narrated to me that Safwan ibn Sulaym informed him on the authority of a number of the sons of the Companions of the Messenger of Allah, may Allah bless him and grant him peace, on the authority of their fathers, on the authority

The citizen : A non -Muslim who is not a Muslim and is peaceful, a partner in the homeland in paying taxes and defending the homeland… He has what a Muslim has and is not harmed… This is from the understanding of reality… Accordingly

: The intended meaning of the hadith is : A Muslim is not killed by a non-Muslim combatant wherever he is found under certain circumstances…

Allah the Almighty said : And do not kill the soul which Allah has forbidden, except by right. This He has enjoined upon you that you may understand (151) (Al-An`am).

Allah the Almighty said: “And do not kill the soul which Allah has forbidden, except by right. And whoever is killed unjustly - We have given his heir authority, but let him not exceed limits in taking life. Indeed, he has been supported.” (33) (Al-Isra’) The verse says: “And whoever is killed unjustly,” meaning whoever is killed unjustly, whether he is a Muslim or a disbeliever; the Muslim ruler is his heir in his blood… It

is authentically reported on the authority of Umar ibn Abdul Aziz that he wrote to one of his commanders about a Muslim who had killed a dhimmi, and he ordered him to hand him over to his heir, so if he wished he could kill him, and if he wished he could pardon him… So he was handed over to him and his neck was struck. (Al-Musannaf by Abd al-Razzaq, Vol. 10, p. 101) .

The second aspect : The hadith had a special position in a sermon delivered by the Prophet Muhammad on the day of the conquest of Mecca, to stop the blood that had been shed and to turn the page…

This is Musnad Ahmad, No. 6403. Waki narrated to us, Khalifah ibn Khayyat narrated to us, on the authority of Amr ibn Shuayb, on the authority of his father, on the authority of his grandfather,

that the Prophet, may God bless him and grant him peace, said in his sermon while he was leaning his back against the Ka`bah: “A Muslim is not to be killed for a disbeliever, nor one who has a covenant during his covenant .”

Even if his statement: “A Muslim shall not be killed for an unbeliever , nor a person with a covenant in his covenant” is understood in general terms : meaning that the unbeliever who is a dhimmi has the same ruling as a Muslim; his blood is spared like the blood of a Muslim…

And thus : ” A Muslim or a dhimmi shall not be killed for an unbeliever who is at war… ”

Secondly: The statement of the Prophet Muhammad (peace be upon him): ” A Muslim shall not be killed for an unbeliever ” does not mean that killing an unbeliever who is at war outside the battlefield without the knowledge of the ruler… does not entail punishment in some cases…!

The ruler may impose a discretionary punishment on him, such as: imprisonment, flogging, fining, exile…

As for the killing of a Muslim citizen by a non-Muslim citizen who is at peace, the matter is up to the ruler, “the guardian of the murdered person,” which is represented today in the law known by custom in the country…

Heritage books have mentioned the sayings of many jurists that whoever kills an unbeliever by treachery, meaning: “treacherously and deceitfully” or intentionally; He is to be killed, and this is the doctrine of Malik and Al-Layth ibn Sa’d.

It is stated in the book (Nail Al-Awtar by Al-Shawkani, Vol. 7, p. 154) .

Malik and Al-Layth said : If a Muslim kills a dhimmi by treachery, he is to be killed for it, otherwise he is not to be killed for it . End quote. This

is what Abaan ibn Uthman did when he was the governor of Madinah. A Muslim man killed a Copt, he killed him by treachery, so he killed him for it. Abaan is considered one of the jurists of Madinah. (Al-Jawhar Al-Naqi with Al-Sunan Al-Kubra, Vol. 8, p. 34) .

Al-Sha’bi, Al-Nakha’i, Ibn Abi Layla , Uthman Al-Batti, Abu Hanifa and his companions held that a Muslim is to be killed for a dhimmi, due to the generality of the texts requiring retaliation from the Qur’an and Sunnah, and due to their equality in the perpetual inviolability of blood, and because it was narrated that the Prophet killed a Muslim for a covenantor. He said:“I am the most generous of those who fulfill their obligations ” (Narrated by Abd al-Razzaq and al-Bayhaqi).

It was narrated that a Muslim man was brought to Ali who had killed a man from the People of the Covenant , and evidence was established against him, so he ordered that he be killed. His brother came and said: I have forgiven him. He said: Perhaps they threatened you and separated you. He said: No, but killing him does not return my brother to me, and they compensated me and I was satisfied. He said : You know best; whoever has our covenant, his blood is our blood, and his blood money is our blood money . (Narrated by al-Tabarani and al-Bayhaqi in al-Sunan al-Kubra, vol. 8, p. 34).

Third : There are questions that arise :

Do the American authorities treat an American citizen like a resident (immigrant) in terms of rights and duties…?

The answer : The rights of a citizen of the country differ from the rights of an immigrant,

and this is known in all customs. Is the discrimination here by the authorities a form of injustice or racism, or is it a right available to this country?

The answer : A right available to it; Because the country in which he was raised and grew up is different from the state of the immigrant…

This is what America and civilized Europe see in the eyes of the objectors…!!

I wonder : Is this injustice or racism…?!

Fourth: The Holy Book attributed racism in blood and killing to the Prophet Moses (peace be upon him); he deliberately killed an Egyptian; Because he fought with an Israelite of his own nation… This is in the Book of Exodus, Chapter 2, Verse 11: And it came to pass in those days, when Moses was grown, that he went out to his brothers to see their burdens, and he saw an Egyptian striking a Hebrew, one of his brothers. 12 And he looked this way and that, and saw that there was no one there, so he killed the Egyptian and hid him in the sand.

I wonder : When Moses killed the Egyptian as the text stated, the meaning was: “A Muslim shall not be killed for an infidel”?!

: “An Israelite shall not be killed for an infidel Egyptian”?!

The New Testament attributes to Jesus Christ texts and actions that indicate racism at its peak… including:

1Matthew’s Gospel, Chapter 7, Verse 6 “Do not give what is holy to the dogs, nor throw your pearls before swine.”

Mark’s Gospel, Chapter 7, Verse 27-2

“But Jesus said to them, ‘Let the children be filled first, for it is not good to take the children’s bread and throw it to the dogs

I wish the objectors would tell me about the Inquisition when the Crusaders entered Andalusia after the fall of “Granada” and killed everyone in it, and established the “Inquisition” and no Christian was killed for a Muslim. Is this racism or not?! And

when Jerusalem fell at the hands of the Crusaders and seventy thousand Muslims were killed in one day for no reason, were they not fighting racism or not?!

Was the meaning not to kill a Crusader for a Muslim?!
